Data protection policy of Digicomp Academy AG, Digicomp Academy Suisse Romande SA and Somexcloud GmbH (hereinafter ‘Digicomp’)

Digicomp thanks you for your interest in our website. We take the protection of your personal data in its collection, processing and use during your visit to our website very seriously. Consequently, all our online activities are conducted in accordance with applicable data protection and data security laws. To provide customer-focused and relevant services, Digicomp has to be able to collect and process user data.

Through use of our website www.digicomp.ch and/or registration for or acceptance of our service, you agree to the processing of data by Digicomp as described below.

 

1. Data collection and processing

Digicomp uses common data capture tools, such as cookies, to collect information about visitors to its website. Every time our website is accessed or a file stored on the website is retrieved, this information is logged. The information is stored for internal system-related and statistical purposes. The type of information logged includes, for example, the name of the file accessed, date and time of access, volume of data transferred, notification of successful retrieval, web browser and requesting domain. The IP address of the computer requesting the file is also logged.

2. The personal data collected

Personal data is collected only when you provide such information voluntarily – for example, when you register for a course or create a mydigicomp account. Digicomp also requests personal information in other instances, such as when you take part in a competition, use additional offers or make an enquiry. Digicomp saves your correspondence. Digicomp stores and processes personal data such as first and last names, e-mail addresses, delivery and billing addresses and telephone numbers. Your data will be retained for as long as it serves the purpose of fulfilling the service and in compliance with legal requirements, such as auditing obligations.

3. Use and transfer of personal data

Digicomp collects and processes personal data partly data on individual learning success in order to be able to provide customer-focused and relevant services. Digicomp stores personal data in particular for identification, billing and marketing purposes. Marketing purposes include notifications of events, competitions and surveys, as well as information about products and services offered by Digicomp and its partners.

Your personal data and partly data on individual learning success is shared with third parties, particularly cloud service providers, when necessary for course or contract processing, billing, identification or customer-focused marketing.

Digicomp uses your email address to send out its newsletter, for which it requires your confirmation that you agree to its receipt. You will also receive regular offers from us by email if you book a course or purchase a service. If you no longer wish to receive newsletters or advertising communications, you may withdraw your consent at any time. We also use the data we collect during your visit to display banner advertising. This is facilitated mainly through the use of cookies or pixels. Our aim is to make the advertisement offer as relevant and interesting to you as possible. In the case of competitions, we use the data to notify prize winners and to promote our offers. Further details can be found in the participation conditions of the relevant competition.

For payment processing, you will be directed to the payment service provider’s website via a hyperlink. The payment service provider’s conditions apply exclusively. No payment-related data is stored on Digicomp’s servers.

4. Where data is processed

Digicomp and third-party agents, in particular cloud service providers, may store personal data domestically and abroad, including outside the EU. Processing is carried out by Digicomp staff or training partners.

5. Google Analytics

This website uses Google Analytics. Google Analytics uses cookies, text files that are stored on your computer and which enable analysis of your use of the website. The information generated by the cookie about your use of this website is generally sent to and stored on a Google server in the US. However, your IP address is first truncated and anonymised by Google in a member state of the European Union or other state party to the European Economic Area agreement. Only in exceptional cases is the complete IP address transmitted to a Google server in the US and truncated there. Google uses this information on behalf of this website’s operator to evaluate your use of the website, to compile reports about website activity and to provide further services relating to website and internet usage to the website operator. Google may also transfer this information to third parties if this is prescribed by law or if third parties process this data on Google’s behalf. The IP addresses sent by your browser for the purposes of Google Analytics are not combined with other data from Google. You can prevent storage of cookies by configuring your browser software accordingly; however, please note that if you do so, you may not benefit from the full functionality of this website. 6. Google AdWords conversion tracking

This website uses the online advertising service ‘Google AdWords’ and, as part of that, conversion tracking. A conversion tracking cookie is stored whenever a user clicks on an ad delivered by Google. These cookies deactivate after 90 days and are not for the purpose of personal identification. If you visit certain pages of this website while the cookie is still active, we and Google may know that you clicked on the ad and were directed to this page. Every Google AdWords client receives a different cookie. Thus, cookies cannot be tracked across AdWords customers’ websites. The information collected via conversion cookies helps Digicomp compile conversion statistics. We find out how many users have clicked on our ad and been directed to a conversion tracking tag page. However, we do not receive any information that would enable us to identify the individual user. If you want to disable tracking, you can deactivate the Google conversion tracking cookie in your internet browser settings. You will therefore not be included in conversion tracking statistics.

7. Facebook pixels

This website uses Facebook’s Website Custom Audiences communication tool. Facebook pixels installed on our website flag you anonymously as a visitor to our website without identifying you as an individual. If you later log in to Facebook, a non-reversible and non-personal hashed value from your user data is shared with Facebook for analysis and marketing purposes. This means that Facebook can associate the visit to our site with your user account. We can use the information collected to display Facebook ads. The Facebook cookie is retrieved for the Website Custom Audiences product. Further information on the purpose and scope of the data collected via Facebook and subsequent processing and use of that data, as well as settings options for protection of your privacy, are contained in Facebook’s data protection policy, which can be found at www.facebook.com/ads/website_custom_audiences and at https://www.facebook.com/privacy/explanation among other locations. 8. Retargeting

Our website uses retargeting technology. We use such technology to make our internet offering more relevant to you. It enables internet users who have previously shown an interest in our shop and our products to be addressed by advertisements on our partners’ websites. We believe that displaying personalised, interest-based advertisements is generally more useful to the internet user than advertising that has no personal relevance. These advertisements are displayed on our partners’ sites based on cookie technology and analysis of previous user behaviour. This form of advertising is completely pseudonymised. No personal data is stored and no user profile is associated with your personal data. You consent to the installation of cookies and therefore to the collection, storage and use of your user data. Furthermore, you agree that your cookie data will continue to be stored after your browser session has ended and that it may, for example, be retrieved when you next visit the website. This consent may be withdrawn at any time with future effect by disabling cookies in your browser settings.

9. Remarketing tags

This website uses remarketing tags. A remarketing tag is a designated JavaScript element that is inserted in the website’s source code. When a user accesses a page on this website containing a remarketing tag, an online advertising provider (e.g. Google) places a cookie on that user’s computer and directs it to relevant remarketing audience lists. This cookie also serves to run remarketing campaigns (‘interest-based advertising’) on other websites. Studies have shown that the display of interest-based ads is more useful to users than advertising that has no direct connection to their interests or previously visited websites. Third-party providers, including Google, use these cookies to deliver ads based on a user’s previous visits to our website. No personal data is stored in the process. 10. Share buttons

We include hyperlinks on our website to various social networks. These require activation by you in order to establish contact with the respective social network. When you click on a social media button and thus activate the link, a new window will open where you can log in to the social network and, for example, like or share the page in question. We do not share data about you with social networks at any point unless you activate the link.

11. Significance of external links

The Digicomp website contains links to third-party websites. Such links do not imply that Digicomp approves of the content of the sites to which it contains links. These sites are the exclusive responsibility of their operators. Digicomp checks the linked websites regularly to ensure they are legally compliant and up to date. However, it is not possible to keep a permanent watch on these sites. As soon as Digicomp discovers out-of-date or questionable content on the linked websites, the links are removed or the operator informed of the issue.

12. Content protected by copyright

Content published by Digicomp on its website is covered by Swiss copyright law and may not be copied, imitated or otherwise used, in whole or in part, without Digicomp’s written consent. Our consent is not required for downloading content for private use or in connection with a course registration.

13. Digicomp’s liability

Use of this website is at the user’s own risk. Digicomp disclaims any liability that may arise from or in connection with the use of this website.

14. Jurisdiction

This privacy policy is subject to the provisions of Swiss law. The sole place of jurisdiction is Zurich.

15. Your rights to rectification and access

Users may edit their account details at any time by logging in with their username and password. For any other correction issues or to delete their account, users may contact datenschutz@digicomp.ch.

The user may request information as to whether further data is being processed about them. Such queries can be sent to datenschutz@digicomp.ch. Please include a copy of your ID card or passport to enable us to confirm your identity.
