Digicomp Academy AG, Zurich and Digicomp Academy Suisse Romande SA, Geneva (Digicomp)

These General Terms and Conditions (GTC) regulate the legal relationship between you as the ordering party/customer and Digicomp. They apply to every offer proposed by Digicomp. You acknowledge these GTC by registering or accepting an offer. Differing conditions require Digicomp's written agreement.

Conditions | Value-added tax

Prices can be referenced from the corresponding course descriptions on our website. The stated currency (CHF, EUR) is binding. All prices usually exclude value-added tax. Educational services provided in Switzerland are exempt from value-added tax, which is therefore not applied; Digicomp reserves the right to opt for value-added tax voluntarily. Statutory value-added tax will be applied to all other services rendered. The respective national regulations apply to services provided abroad. The stated prices can be changed at any time without specific notification.

Registration | Ordering | Payment

We look forward to receiving your order online via our website or by email, telephone or post. Your registration obligates you to pay the course fee via the post office, your bank or credit card. The invoice will be sent to the invoice address defined in the order. The payment date referenced in the invoice is binding. Digicomp reserves the right to require down payments, dunning fees or interest on arrears.

Course services

The duration, price, currency, course objectives, content, target group and implementation details can be referenced from each course description. Course documentation, literature, material, use of IT systems, Wi-Fi and refreshments (coffee, water, croissants, fruit) are included in the course fee. Travel and accommodation expenses and other sustenance costs are to be paid by the customer.

Success guarantee

Course participants who do not achieve the published course objective have the option to repeat the course content during one of the subsequent courses with free places. The success guarantee is valid for one year.

Repetition option

If you ascertain within 12 months that you have lost the knowledge you acquired due to a lack of opportunities to put it to use, you can repeat the course you attended or parts of it once free of charge. Conditions: we confirm to you in writing that there are free places for the course and you use your own documents and materials.

Guaranteed implementation

We guarantee both the dates and the location of the training courses indicated accordingly on our website.

We guarantee the dates of the training courses indicated accordingly on our website, but the location is subject to change. 

No guarantee of implementation

All of the courses proposed by us are implemented as far as possible. You will be informed by Digicomp in good time if the number of course participants is inadequate. In the event of inadequate participant numbers, Digicomp may – subject to the agreement of the course participants – implement the course at a higher price per participant or, if expedient, reduce the course duration. Digicomp is entitled to cancel a course up to 10 working days prior to the start of the course. You are at liberty to have your registration transferred to another course free of charge. Course fees will be reimbursed to you in full in the event that Digicomp is compelled to cancel a course.

Certificates

All participants who successfully complete the course will receive a Digicomp Certificate that is highly respected and acknowledged in the industry.

A deregistration or transfer request must be submitted in writing and confirmed by us in writing. A deregistration or transfer is considered as submitted on the day it reaches Digicomp.

Clients are not entitled to a reduction or reimbursement if they cannot attend the course (due to illness, military service, work pressure, other reasons) or if the course is terminated prematurely without good reason. If good reason is given (protracted illness/accident), Digicomp can, at its discretion, offer an opportunity to rejoin a different course.

You are entitled to a replacement if Digicomp is unable to provide a course or implement instruction on a day of a course. If you are unable to attend on the day the replacement course or instruction is held, Digicomp is not obligated to offer a different form of instruction; you are required to acquire the knowledge through self-study. Participants who travel fruitlessly to a course location are entitled to a one-off compensation payment of CHF 100 per person maximum for courses or training days that do not take place due to force majeure (e.g. illness or accident involving the instructor).

Changes

Digicomp Academy AG reserves the right to change its course programme and these GTC at any time. Contracts are governed by the GTC in force at the time of contract conclusion. Currently applicable regulations can be viewed on our website www.digicomp.ch/agb at any time.

Intellectual property rights and copyright

When you register, you undertake to observe the following stipulations: course documentation and the software used during the course (operating systems and all applications) are subject to copyright and are personal. It is prohibited to copy software or to remove it from the course classroom. Unless permitted in writing by Digicomp, it is prohibited to reproduce, print, translate or electronically process course documents, texts and photos or to hand them over to third parties for internal or external use. All documents are the intellectual property of Digicomp. Third parties are not permitted to use the forums.

Privacy policy

By registering or accepting an offer, you declare your agreement with our Privacy policy.

Viruses

Digicomp goes to great lengths to ensure that its infrastructure is virus-free, but is unable to guarantee such conditions. We reject any and all liability for damages caused by viruses if participants copy Digicomp files.

Insurance

Every participant is responsible for obtaining adequate insurance coverage for all courses and events organised by Digicomp. Digicomp cannot be held liable for stolen or lost property. Participants use equipment belonging to Digicomp at their own risk.

Final stipulations

The contractual relationship is subject exclusively to Swiss law.

The place of jurisdiction is 8005 Zurich.

Additional General Terms and Conditions for company courses

Conditions | Value-added tax

Digicomp will prepare an offer for company courses on the basis of your enquiry. Written offers are non-binding until the customer places a written order and the order is confirmed by Digicomp. Offers are valid for 30 days.

Ordering | Order confirmation | Payment

Digicomp will confirm your acceptance of the offer by way of a written confirmation that obligates you to pay the course fee. The invoice will be sent to the invoice address defined in the order confirmation.

Competition

The customer and Digicomp mutually undertake not to poach personnel from one another. In particular, the customer shall not employ lecturers, course instructors and department managers employed by Digicomp for his own further education and training measures.

Course content / Course prerequisites

Unless agreed otherwise, the course content is the same as the standard teaching content published on the website. Customised adaptations to the course content and the corresponding course documents must be agreed in writing and will be charged to the customers as described in the offer/order confirmation. Digicomp will specify the necessary course prerequisites to be fulfilled by all participants to ensure that they understand the subject matter. The customer shall endeavour to only send participants to Digicomp courses who fulfil the prerequisites.

Infrastructure

Course classrooms at Digicomp are equipped with the required seminar room infrastructure for each course including hardware and software for 6 to a maximum of 24 participants.

The customer is responsible for providing the necessary hardware and software for courses held at the customer's premises or, on the customer's request, at a seminar centre that is not run by Digicomp. The customer shall provide the following infrastructure at the course location: PCs (one per participant and one for the course instructor), network (with fast internet access) and any required peripherals such as network printers, plotters, scanners, visualisers/overhead projectors, teaching network (hardware or software), projectors, flipcharts and/or whiteboards. The exact technical configuration must be reported to Digicomp in good time. The customer shall provide an employee responsible for the technical infrastructure. The customer shall be liable for all consequential costs (additional lecturers, expenses, participant claims, etc.) if a course cannot be carried out or cannot be carried out on time because of a lack of equipment or a malfunctioning infrastructure. The customer is responsible for delivering the course documents provided by Digicomp to the course location.

Course dates

Course dates must be coordinated with Digicomp as soon as possible. Reservations for course classrooms and course instructors can only be maintained for a maximum of 7 days without a binding written confirmation from the customer.

A cancellation or postponement must be submitted in writing and confirmed by us in writing. Cancellations and postponements can be submitted at any Digicomp training centre. A cancellation or postponement is considered as submitted on the day it reaches Digicomp.

Clients are not entitled to a reduction or reimbursement in the event that individual participants of a company course cannot attend the course (due to illness, military services, work pressure, other reasons) or if the course is terminated prematurely without good reason. If good reason is given, Digicomp can offer an alternative at its discretion.
